With four days until New York plans to start charging a $9 congestion pricing fee to enter Lower Manhattan, New Jersey’s attorneys are going back to court to slam the brakes on starting the controversial program.

“We welcome the court’s ruling today in the congestion pricing lawsuit. Because of New Jersey’s litigation, the judge has ordered a remand, and the MTA therefore cannot proceed with implementing the current congestion pricing proposal on Jan. 5, 2025,” said Randy Mastro, the attorney representing New Jersey in the case.

Singapore has it, London has it, Stockholm has it. And now, congestion pricing looks like it’s coming to the United States for the first time. Starting Sunday, New York City plans to charge passenger cars, trucks and buses to drive into midtown and lower Manhattan during peak hours, beyond bridge or tunnel tolls.

The decision in a lawsuit brought by the State of New Jersey meant that the tolling plan could go ahead as planned, New York said. A lawyer for New Jersey disagreed.

A dizzying array of exemptions, credits and existing tolls makes it tricky to calculate how much drivers will actually pay when they enter Manhattan south of 60th Street.

Manhattan’s congestion pricing program is set to begin Sunday, Jan. 5, following a ruling by a federal court judge in New Jersey — although the parties on either side of the lawsuit involved disagree whether the ruling allows that to happen.
